This legal notice (these Terms ) includes details of how Samsung Electronics UK Limited of Samsung
House, 1000 Hillswood Drive, Chertsey, Surrey KT16 0PS (registered number 03086621) ( Samsung )
will use personal and other data which Samsung may access during the course of providing services
(being technical support services) (the Services ) to you, as well as other related points. These
Terms apply in addition to any other terms and conditions which may apply regarding the Services. If there is any conflict between such other terms and conditions and these Terms, these Terms shall prevail.
During the course of requesting or receiving the Services, you may provide Samsung with personal data. Samsung shall use this personal data only for the purpose of providing the Services and shall hold such personal data in accordance with Samsung s Privacy Policy, available at http://www.samsung.com/uk/info/privacy.html. PLEASE READ THIS POLICY CAREFULLY it deals with your rights and Samsung s obligations in relation to any personal data provided to Samsung in connection with the provision to you of the Services. By accepting the Services, you hereby agree to
Samsung s Privacy Policy.
During the course of delivering the Services, Samsung may gain access to personal and other data
(potentially to include sensitive personal data) held on your mobile phone or PC by means either of remote access or by way of you entering a keystring on your device (or by some other means of which you will be notified). By accepting the Services, you agree that Samsung may view any such data
(including potentially sensitive personal data and personal material) while carrying out the Services.
Data to which access is gained in this way will not be used by Samsung for any purposes other than providing the Services. Notwithstanding the foregoing, Samsung will co-operate with law enforcement and other relevant authorities with respect to any investigation or violation of network security or laws and reserves the right to disclose any information (including personal data) derived from you as required by law.
You agree that, in the course of providing the Services, Samsung (through its technical support staff),
may temporarily take over control of your Samsung product, via remote control of your keyboard and or any device(s). You also agree that the technical support staff may, if necessary or appropriate,
check your Samsung product s specifications, including memory capacity and system setting information.
You agree that, in the course of providing the Services, Samsung (through its technical support staff)
may record, via screen capture, video recording or other means, all activities forming part of the
Services. In addition, Samsung may install firmware developed by or on behalf of Samsung in order to solve technical problems, and such installation may delete your personal settings.
You are responsible for backing up your own system and content and you must ensure that all of your content is backed up prior to the commencement of provision of the Services. In no event shall
Samsung be liable to you for any loss of data, information or content, however caused, and whether or not Samsung was advised or aware of the possibility of the same and whether such losses or damages arise in contract, tort (including negligence) or otherwise.
Nothing in these Terms shall exclude or limit Samsung s liability for death or personal injury caused by its negligence, or for fraud including fraudulent misrepresentation, or for any other liability which may not be limited or excluded by law.
These Terms shall be governed by and construed in accordance with English law and the courts of
England and Wales shall have exclusive jurisdiction to settle and resolve any dispute which may arise in connection with the validity, effect, interpretation and/or performance of these Terms or otherwise arising in connection with these Terms or the Services.
