Digital Services Act (DSA): Nintendo Transparency Report for the EU market as at 28th February 2025
Introduction:
At Nintendo, we want to create experiences that put smiles on faces for everyone. In order to achieve this, it is crucial to keep our Nintendo games, and online services safe, friendly, welcoming, and fun for all. Our Community Guidelines outline our expectations when engaging with our Nintendo products or services. The Nintendo Code of Conduct in the Nintendo Account Agreement also prohibits any illegal, harmful or otherwise inappropriate conduct.
We also implement appropriate reporting systems for content moderation to ensure our online services safe and fun for our customers. These are also aligned with the requirements under the applicable laws, including the Digital Services Act (DSA).
We acknowledge that Nintendo Switch Online offers certain online services which may fall within the scope of an intermediary service or hosting service under the DSA. Therefore, pursuant to Article 15
of the DSA, we are publishing the transparency report for Nintendo Switch Online in our EU market to outline the content moderation activities we engage in, as required by the law.

Nintendo has a dedicated moderation system and team to ensure the online safety of our services. Nintendo has implemented reporting systems in relevant online services so that our customers can readily report any potentially problematic content they encounter, and designate the applicable category of concern within the report. These reports are registered on our content moderation system and our moderation team reviews these reports to identify any problematic content.
Nintendo in principle has two measures to take in cases where it confirms content is problematic:
(1) deletion or blocking access to user-generated content ( UGC removal ) and/or (2) restriction of an application's online functionalities ( application ban ).
All UGC removal and application bans are taken on the basis of our terms and conditions,
including Nintendo Account Agreement, which prohibits any illegal, harmful or otherwise inappropriate conduct when using the Nintendo Account service. More detailed report categories are set out in the table below.
Our moderation team works 365 days a year supporting multiple languages, and makes a judgement within 24 hours upon the receipt of the report in principle. Our moderators are welltrained by clear instructions and training measures, and are aided by our efficient moderation system. In case of any doubt, moderators can immediately escalate the matter to relevant stakeholders including, but not limited to, the software development team and/or legal teams.
Nintendo has not implemented automated means such as artificial intelligence and machine learning algorithms for moderation.
