UK Online Safety Act: Additional information for users in the United Kingdom
To comply with the relevant sections of the UK Online Safety Act 2023, the following additional provisions are now applicable to subscribers of Nintendo Switch Online
(NSO) in the United Kingdom.
Capitalised terms used below have the same meaning as set out in the Nintendo
Account Agreement.
1. You can go to court: You may be entitled to bring a claim for breach of contract against Nintendo in the event that either:
(i)
Nintendo wrongfully removes, blocks or restricts User-Generated Content shared by you via your Nintendo Account in breach of the Nintendo Account
Agreement; or
(ii)
you are wrongfully suspended or banned by us from using any part of the
Nintendo Account Service that features User-Generated Content in breach of the Nintendo Account Agreement.
2. Providing safe services: Nintendo uses advanced technology to ensure that you are protected from encountering illegal content. For example, Nintendo has a dedicated moderation system and team to ensure the online safety of Nintendo
Switch Online. Nintendo has implemented reporting systems in relevant online services so that our customers can readily report any potentially problematic content they encounter, and designate the applicable category of concern within the report. These reports are registered on our content moderation system and our moderation team reviews these reports to identify any problematic content.
In addition, parents and guardians can use Nintendo Switch Parental Controls to monitor children's gameplay time, set age rating restrictions, and prevent online communication.
3. Proactive technology to protect you: Nintendo uses certain proactive technology to help prevent and mitigate the risk of you encountering illegal content. For example, Nintendo uses automated filtering to block offensive usernames.

4. Complaints handling: Nintendo treats all complaints seriously and applies a stringent complaints handling procedure to ensure that user concerns are addressed fairly and efficiently. If a user reports illegal content on Nintendo
Switch Online, we will promptly review the complaint, take necessary action,
and provide updates on the outcome. If a user believes we have failed to meet any of our legal duties regarding online safety (particularly in respect of illegal content, content reporting, or freedom of expression and privacy), we will investigate the issue and take corrective measures where necessary.
